Stradia was appointed by North Yorkshire County Council (NYCC) to undertake a review of their in-house NEC3 Framework Contract with design consultancy Align Property Partners (Align). The review took into consideration all aspects of the existing contract terms and conditions including the fee structure.

The Framework Contract operated through the issue of work orders in the form of the NEC3 Professional Service Contract and the NEC3 Professional Service Short Contract, dependent upon the size and complexity of the work.

During the review NYCC and Align advised Stradia that they considered the contract management processes to be too complex for their needs, and also that both parties were more familiar with the JCT suite of contracts.

Following a detailed examination of the existing contract, Stradia prepared a report setting out a series of recommendations. Stradia was subsequently commissioned to prepare a new contractual arrangement between NYCC and Align, based on the JCT Consultancy Agreement (Public Sector) 2016.

Working closely with the NYCC team, Andrea drafted the JCT Consultancy Agreement including a number of bespoke clauses to suit NYCC’s requirements. She also provided NYCC with advice which enabled them to agree the fee structure with Align and drafted the Client’s Brief which is a key contract document.

Stradia worked closely with NYCC and Align to draft and agree a contract which both parties are much more comfortable with than the previous arrangement.
